Domain registration services

Introduction

This is a Schedule to the General Terms and Conditions of Service of Redcentaur Hosting and is applicable to domain registration services.

Specific definitions

Domain registration

Domain registration is the service we provide to our customers whereby we arrange for the registration of domain names and ancilliary services with the relevant registry.

Registration services

Domain names

If we provide you with a domain name, it will be provided on a 12 month registration unless otherwise stated in the order acceptance. 

You are responsible for providing accurate and valid information to enable the registration of the domain name and paying us the registration fees for us to register the domain for you.

If you have an existing domain name that you want to transfer to us as part of the hosting package, you are responsible for providing us with all necessary information to enable the transfer, paying the transfer fees to us and doing everything necessary to enable the transfer to take effect promptly, including releasing the domain from its current registrar and confirming the transfer with the registry in a timely manner, and in all cases within five days.

You can add domain names to the hosting we provide you within the limits set out in the package you have ordered.

Registration periods

Domain names are registered for a period of 12 months, unless otherwise stated in the order acceptance. Domain names are automatically renewed at the end of every period and you will be invoiced for the next period one month in advance of the registration expiry date, or one month in advance of the expiry of your hosting package, whichever is most convenient.

If you do not wish to renew a domain name, you must inform us within 15 days of receiving an invoice for renewal so that the domain name can be released. If you do not let us know, or take action to transfer or release the domain name, you will be responsible for any fees incurred in renewal of the domain name.

If you do not inform us that you wish to release the domain and fail to pay the renewal fees, you may lose the domain name. If you decide to renew the domain name after the expiry date, you will be required to pay additional fees for the renewal.

Information requried by a domain name registry

You authorise us to release personal information about you to a domain name registry, as required by an order to transfer, renew or purchase a domain name.

You are responsible for ensuring that the information you provide to us is accurate, valid and uptodate and you are responsible for ensuring that your registration remains accurate at all times. You are responsible for validating your identity with the registry, as required by them from time to time and otherwise complying with registry regulations and requirements as set out in the Domain Names Schedule.

Termination of agreement

If your agreement with us is terminated for whatever reason prior to the expiry of the domain name registration, you will remain liable for all costs associated with the domain name. If there are outstanding fees relating to the domain name registration, we may refuse to allow the domain name to be transferred until such time as all outstanding fees are paid to us and your account is in balance. If such fees are not paid, your domain name will be deregistered at the end of the registration period.

We are unable to refund costs associated with domain name registrations if an agreement is terminated.

Application of terms and conditions

If you have domain name(s) registered through our registration service in conjunction with our hosting service, the Domain Names Schedule will also be applied to the agreement.

No warranty

We use several third parties to register domain names for us—we are a reseller of their services. If we provide you with domain registration servcies, we do not warrant that:

• the domain names requested will be accepted for registration by the relevant registry; or,
• any registration will be successful.

We have no liability if any domain name chosen by you infringes the Intellectual Property Rights or any other rights of any third party. Also, we have no liability if the domain name chosen by you is taken by a third party prior to the domain name being registered in your name and therefore becomes unavailable to you.

Domain name registration fees

Any charges that apply to the registration of one or more domain names on your behalf will be listed during the order process prior to your confirmation of the order. Our current fees for domain name registration, transfer and renewal are listed on our website and updated from time to time. The fee you are responsible for paying is the fee advertised at the time we invoice you for domain registration, transfer or renewal.

Domain name registries

The registration of the domain name you choose, and the ongoing use of that domain name is subject to the relevant domain name registry's terms and conditions and by submitting an application for registration, you agree that you have requested, considered and accepted those terms and conditions. 

Cancellation or suspension of domain name registration by us

We reserve the right to suspend or cancel any application for registration of a domain name or refuse to host any domain name if you are or we reasonably believe you are in breach of this agreement or the terms and conditions of the relevant registry.

Renewals

You are responsible to ensure that any domain names that you register as part of this agreement are renewed when necessary and all relevant renewal fees are paid in a timely manner. We will inform you that a renewal date is impending at least thirty days before the domain name is due for renewal. We have no liability for your failure to renew any domain name registration.

Expired domains

If you request that you no longer wish to have your domain name renewed by us or fail to pay all relevant renewal fees, it will be left to expire and any domain name services that we provide for that domain name will be suspended. 

On reaching the expiry date, your domain name will be put into a protected period, after which your domain name will be suspended by the registry and will go into a grace period. The protected period and grace period used by different registries differ.

If you change your mind and still wish to renew your domain name within the grace period, you can do so but you may be charged additional fees as set out by the domain name registry in addition to any fees that we may charge for the renewal of the domain name. All outstanding fees must be paid by you in full before the domain name is renewed.

If you do not change your mind, after the grace period ends your domain name will be cancelled and deleted from the register and made available for resale through a third party registrar. We cannot guarantee the renewal fo a domain name after the end of the grace period.

We have no liability for any failure by you to act in a timely manner to make arrangements with us to redeem any domain name registration within the grace period or for any subsequent failure of the domain name to be renewed.

Rights to domain name

By submitting an order for registration of a specific domain name, you warrant that you have the right to use that domain name.

Service level

We will acknowledge all requests for support relating to domain name registration within three business days. We aim to resolve any request for support in relation to domain name registration within five business days after the date of acknowledgement, although we cannot guarantee any particular result or outcome or within any particular time.

ICANN required disclosures

Domain name registration requires sharing the registrants personal or organisational information with the applicable registry and with ICANN. ICANN requires that this information must be made publicly available by means of a “Whois” and the registry also may be required to make this information publicly available by Whois. It may be required for this information to be archived by a thirdparty escrow service. 

As a registrant you consent to and give permission for all such required disclosures. You represent and warrant that if you are providing information about a third party, you have notified the third party of the required disclosures and the purpose of the disclosures. 

By ordering domain registration services you agree to the relevant disclosures and acknowledge your responsibility in relation to the disclosure of third party information set out above.

Registration dispute resolution

You are bound by all Internet Corporation for Assigned Names and Numbers (‘ICANN’) consensus policies and all policies of any relevant registry, including the Uniform Rapid Suspension Procedure, the Uniform Domain Name Dispute Resolution policy and any supplemental rules. Further information is available from ICANN.

If a third party challenges the registration or reservation of your domain name, you will be subject to the provisions specified in the dispute policy adopted by the applicable registry. In teh event of a domain name dispute, you will indemnify and hold us harmless pursuant to the terms and conditions contained in the applicable policy.

If we are notified that a compalint has been filed with a judicial or administrative body regarding a domain name, we may, at our sole discretion, suspend use of the domain name and the ability to make modifications to the registration records until:

• we are directed to do so by the judicial or administrative body; or 
• we receive notification from both parties that the dispute has been settled.

If you or the subject domain name becomes the subject of litigation, we may deposit control of your domain name record into the registry of the judicial body by supplying a party with a registrar certificate.

Whois privacy service

You may elect to use the Whois privacy service, in which case:

• the publicly available registrant contact information will list Contact Privacy Inc. Customer followed by a unique customer identification number as the registrant and contact name and assign a specific postal address and telephone number as contact information;
• We will keep your details and your contact information on file as per ICANN policy;
• You will retain complete control over the domain name and its registration records and may suspend and reinstate the Whois Privacy Service at your discretion;
• With respect to a domain name that has been transferred to us, the Whois Privacy Servcie will only commence after the transfer has been completed. If you transfer your domain away from us, you must disable the Whois Privacy Service prior to initiating the transfer;
• We will send all relevant renewal and transfer notices to the contacts that you have designated;
• Communications received regarding a domain name registration will be handled as follows:
  • We will forward to you all correspondence received by registerred mail or traceable courier. This information may be opened, scanned and emailed to you. Regular postal mail will be discarded or returned to sender at our discretion;
  • Email correspondence wll be forwarded if submitted via the contactprivacy.com website;
  • a voice mail message will advise all callers that inbound messages will not be accepted; calls will be directed to the contactprivacy.com website.
• We retain the right to suspend or cancel the Whois Privacy Service without liability or notice to you at our sole discretion and to reveal contact Whois information in certain circumstances, including:
  • when required by law;
  • in teh good faith belief that disclosure is necessary to further determination of an alleged breach of the law;
  • to comply with a legal process served upon us or our suppliers;
  • to resolve any and all third party claims including ICANN and Registry dispute resolution policies;
  • to avoid financial loss or legal liability;
  • if we or our suppliers believe that you or one of your contacts is using teh Whois Privacy Service to conceal involvement with illegal, illicit, objectionable or harmful activities or to transmit spam, viruses, worms or other harmful computer programs.

Transfer of ownership

The person named as Registrant on the Whois is the Registered Name Holder. The person named as the Administrative Contact is deemed to be the Registrant's designate with authority to manage the domain name. The Registered Name Holder agrees that prior to transferring ownership of the domain name to another person (the Transferee), the Registrant will require the Transferee to agree in writing to be bound by all teh terms and conditions of this agreement and those of the registry. If the Transferee fails to be bound by these agreements in reasonable fashion determined by us, the transfer will be null and void.

Top Level Domain (TLD) requirements

There are varying requirements set out by the registries for different Top-level domains (TLDs). When you register, transfer or renew a domain name through us, you agree to abide by the requirements relevant to the TLD for the domain name in question. A list of requirements for your specific TLDs is available on request.
